Prices: All prices are F.O.B.
factory, Bradenton, Florida.
Specifications and Changes: Veranda Creations is constantly improving
its designs, materials and manufacturing methods in order to provide the
finest commercial-quality product. Therefore, Veranda Creations reserves the
right to make changes in materials, specifications, prices, styles and
colors without notice, and without incurring any liability or obligation
with reference to similar products previously manufactured. Any measurements
or specifications noted are approximate.
Cancellations: Any orders cancelled after production begins will be
subject to a 25% restocking charge.
Routing: Orders are sent freight collect unless other prior
arrangements are made. Unless otherwise specified, the factory will use its
best judgment and ship the best way via our shipping resources.
Claims for Shortages: Claims for shortages must be made immediately
after receipt of the goods. Our responsibility on all shipments ceases
after acceptance of the goods by the transportation company. No
allowance is made for freight overcharges.
Loss or Damage: Carefully inspect all shipments before accepting them
from the Carrier. The risk of loss for the goods passes to the Buyer
at the time the goods are delivered to or picked up by the Carrier.
Merchandise is carefully packed and thoroughly inspected before leaving our
factory. The Carrier assumes full responsibility for the safe delivery of
the goods upon their acceptance of the shipment. Veranda Creations will
provide all possible assistance in settling claims, however all claims for
loss or damage sustained in transit must be made upon the Carrier as
follows:
(a) Concealed loss or damage means
loss or damage which does not become apparent until the merchandise has
been unpacked. The contents may be damaged in transit due to rough
handling even though the carton may not show external damage. When the
damage is discovered upon unpacking, the Buyer shall notify the Carrier
immediately. Then the Buyer shall file a claim with the Carrier, since
such damage is the Carrier's responsibility. The Buyer shall save all
boxes and cartons.
(b) External evidence of loss or
damage must be noted on the freight bill or delivery receipt, and must be
signed by the Carrier's agent. Failure to adequately describe such
external evidence of loss or damage may result in the Carrier refusing to
honor a loss or damage claim. The Carrier will supply the form required to
file such a claim.
Returned Goods: Returned goods will
be accepted only with prior, written authorization from the factory. No
credit will be allowed for goods returned without our written consent. All
freight charges must be prepaid by the purchaser on any returned goods, and
must be accompanied by a copy of the written return authorization and a copy
of the original invoice.
